Your rights

You stay in control of your data. You can ask us to:

  • Get a copy of your data
  • Correct mistakes in your data

How we protect your data

We use strong security measures based on “zero-trust” cybersecurity to keep your data safe and protected from unauthorized access. For example, we use encryption, firewalls, logging, and network segmentation.

How long we keep your data

We keep your data only as long as we need it for the purposes described below. Most data is deleted or anonymized within 3 years after the later of your last interaction with MileIQ or the expiration of your subscription.

Who we share your data with

We only let other companies access your data to keep MileIQ running, to make our site and app better, to help you when you reach out, to understand how well our marketing works, and when the law requires it. If your organization provides your account, its administrators can see your drives and reports. If MileIQ changes owners, your data goes to the new owner.

We don't “sell or share” (as defined by the California Consumer Privacy Act) your drives, drive history, or drive locations. To understand how well our ads on other websites and apps perform, we share a limited amount of data with our advertising and measurement partners. They only get a pseudonymous identifier and the fact that you signed up or turned on certain app permissions.

Tracking technologies

We use cookies and similar technologies (like SDKs and tracking pixels) to understand how you use our site and app, including your preferences, interests, and behavior, and to improve them. Some of this involves building profiles about you. Some of our partners also collect data through tracking technologies built into our site and app. If you're in Canada, in the EEA or the UK, we ask for your consent before using non-essential cookies and similar technologies.

Purposes

When we say “after the later of your last interaction with MileIQ or the expiration of your subscription,” we mean the later of two dates: when your subscription expires, or the last time you used MileIQ in the app or on the site while logged in.

Operational needs

We need these to make MileIQ work.

Service delivery
  • What this means: To let you use MileIQ and its features.
  • Legal basis: The contract we have with you. We only collect precise geolocation if you allow it in your device settings.
  • How long we keep it: Up to 3 years after the later of your last interaction with MileIQ or the expiration of your subscription, except for:
    • Your drive history, username, and other information you might need for your taxes, which we keep for up to 6 years
    • Your precise geolocation, which we keep for up to 1 year
Service integrity
  • What this means: To enforce our Terms of Service, and to make sure our service is safe and secure.
  • Legal basis: Our legitimate interest in ensuring the security and safety of network and information systems, and enforcing the rules we set out for our platform.
  • How long we keep it: Up to 3 years after the later of your last interaction with MileIQ or the expiration of your subscription.
Troubleshooting
  • What this means: To analyze problems and fix failures and bugs, so MileIQ works properly.
  • Legal basis: Our legitimate interest in ensuring the quality and the proper functioning of our service, beyond cybersecurity and safety.
  • How long we keep it: Up to 1 year after the later of your last interaction with MileIQ or the expiration of your subscription.
Customer support
  • What this means: To respond to your support requests and any messages or emails you send us, and to send you important non-marketing updates (like letting you know that this policy has been updated).
  • Legal basis: The contract we have with you.
  • How long we keep it: Up to 5 years after your support request is handled.
Legal compliance
  • What this means: To fulfill our legal responsibilities.
  • Legal basis: Depending on the situation: legal obligation (for example, if we receive a lawful request from a public authority), vital interest (for example, if providing your data is needed to protect your life or someone else's), or our legitimate interest in demonstrating compliance with the law.
  • How long we keep it: As long as the law requires in each case, but never more than 10 years after the later of your last interaction with MileIQ or the expiration of your subscription.

Specific situations

We only use your data for these if certain events happen, like a sale of MileIQ or a lawsuit.

Corporate changes
  • What this means: If MileIQ is sold to another company or goes through restructuring proceedings, your data will be transferred to the new owner. If another company conducts due diligence into MileIQ before a transaction (like an acquisition or a loan), it may have limited access to user data, but we'll have confidentiality agreements in place.
  • Legal basis: Our legitimate interest in performing corporate transactions to sell or grow the company.
  • How long we keep it: We don't store personal data specifically for this purpose. Any personal data involved is kept according to the periods that apply to the other purposes in this policy. After a transaction, the new owner will keep your data in line with its own privacy policy.
Legal defense
  • What this means: To defend ourselves in a lawsuit or government investigation. We only store data for this purpose if we have a reason to think we'll need your data for our defense.
  • Legal basis: Our legitimate interest in establishing, exercising, and defending our legal rights.
  • How long we keep it: Up to 10 years after the later of your last interaction with MileIQ or the expiration of your subscription, or until the lawsuit is over, whichever comes later.

Other purposes

These help us improve MileIQ and stay in touch with you.

Service improvement
  • What this means: To make MileIQ better, including finding ways to improve it. For example, we might do statistical research into how users use the app to make it easier to use, or analyze the results of surveys to understand what features users would like.
  • Legal basis: Our legitimate interest in improving our product. In Canada, the EEA and the UK, where this involves non-essential tracking technologies, we rely on your consent.
  • How long we keep it: Up to 3 years after the later of your last interaction with MileIQ or the expiration of your subscription.
  • How to opt out (Canada, EEA and UK only): Turn off “Analytics” in the app's privacy settings or on the “Your Cookie Preferences” page linked in the footer of our site.
Customization
  • What this means: To give you a customized experience in the app or site.
  • Legal basis: Our legitimate interest in providing as useful a product to users as we can. In Canada, the EEA and the UK, where this involves non-essential tracking technologies, we rely on your consent.
  • How long we keep it: Up to 3 years after the later of your last interaction with MileIQ or the expiration of your subscription.
  • How to opt out (Canada, EEA and UK only): Turn off “Profiling” in the app's privacy settings or on the “Your Cookie Preferences” page linked in the footer of our site.
Marketing
  • What this means: To market MileIQ and promote sales, including by using profiling to tailor your experience in MileIQ (for example, determining which features are available to you for free). We do this with a machine learning model that uses your usage history, subscription information, device information, approximate geolocation, and preferences. It doesn't use your precise geolocation. We don't sell your personal data.
  • Legal basis: Our legitimate interest in promoting our products and services. Where local law requires it, we rely on your consent for the following:
    • Marketing messages
    • Training the machine learning model
    • Customizing promotional offers
    • Marketing analytics (understanding whether our campaigns are succeeding)
  • How long we keep it: Up to 2 years after the later of your last interaction with MileIQ or the expiration of your subscription.
  • How to opt out (Canada, EEA and UK only): For marketing messages, change your preferences in the “Notifications” section of the app's or site's settings. For analytics, profiling, and machine learning, turn off “Analytics” and “Profiling” in the app's privacy settings or on the “Your Cookie Preferences” page linked in the footer of our site.

Who is my data shared with?

We may share your data with:

  • Companies that help us serve you (“data processors”): These include companies like our IT infrastructure providers and our payment processor. These companies process personal data exclusively under our instructions or to comply with their own legal obligations. For more information, see our Trust Center.
  • Companies that help us run our business: These are companies that don't directly provide you services but that we use to keep our business running, like professional advisors (including accountants or lawyers).
  • Advertising and measurement partners: To understand how well our ads on other websites and apps perform, we share a limited amount of data with advertising platforms and measurement partners (like Meta and Google). They only get a pseudonymous identifier and the fact that you signed up or turned on certain app permissions. They never get your drives, drive history, or drive locations. These partners may use this data for their own purposes, as described in their privacy policies. In Canada, the EEA and the UK, we only share this data if you've given consent, and you can withdraw it at any time in the app's or site's privacy settings by turning off “Profiling”. In the US, you can opt out in the “Your Privacy Choices” section of the app's or site's privacy settings.
  • Your organization: If you use MileIQ through an account provided by your employer or another organization (MileIQ Teams), your organization's administrators can access your drives and reports.
  • Law enforcement, courts, and regulators: We review every law enforcement request to confirm it's legally valid.
  • New owners: If MileIQ is ever sold or transferred to another company, your data goes to the new owner. Potential owners may also get limited access to your data during negotiations, under confidentiality agreements.
  • Other parties, when necessary: For example, we may share data if we have reason to believe that your actions are inconsistent with our Terms of Service or that you've violated the law. We can also share data as necessary to protect our rights, property, and safety, or those of our users, the public, or others.

You have choices about how your data is used. See “What are my rights?” to learn more.

Our site and app sometimes link to third-party websites or services (for example, in advertisements). When you click on those links, their privacy policies apply, not MileIQ's. We have no control over what happens to your data when you use these third-party sites.

Some of our partners collect data directly from you using their own tracking technologies. For more information about the tracking technologies we and our partners use, see our Cookie Policy.

Is my data sent to other countries?

We store your data in the United States. If you're outside the US, we protect your data when we transfer it, as data protection laws require. For transfers from the EEA and the UK, we use the European Commission's Standard Contractual Clauses (“SCCs”) and the UK Addendum. You can ask for a copy of the SCCs at support@mileiq.com.

How long is my data kept?

How long we keep your data depends on what we use it for. You can see the period for each purpose under “Purposes” above. If we use the same data for more than one purpose, we keep it for the longest of those periods.

Troubleshooting, legal compliance, and legal defense can involve any type of data, but only when a specific case needs it. Their periods apply only to the data used for that case.

In practice, we keep most data for up to 3 years after the later of your last interaction with MileIQ or the expiration of your subscription. We keep data you might need for your taxes for up to 6 years. The IRS generally asks people to keep tax records for 3 years after filing, and for 6 years in some cases, so this covers both. We keep precise geolocation for up to 1 year.

What are my privacy rights?

By request: You can ask us to:

  • Send you a copy of your data,
  • Correct mistakes in your data, and
  • Delete your data.

You can make these requests wherever you live, even if local law doesn't give you the right.

If you live in the US, you can also ask us not to “sell or share” your data. If you live in the EEA or the UK, you can withdraw your consent at any time, and we'll stop the processing that relies on it. EEA and UK residents can also object to processing based on our legitimate interest. For details, see “Additional information for US residents,” “Additional information for California residents,” and “Additional information for EEA and UK residents” below.

To exercise your rights, email us at support@mileiq.com. Please include enough information for us to find your account and confirm that it's yours. We may ask you for more information to verify your identity.

By yourself: You can also delete some data (like drives, working hours, notes, tolls, and parking records) in the app or web dashboard. You can also unsubscribe from marketing emails in your account settings in the section “Notifications”.

Can I use MileIQ if I'm under 18?

MileIQ isn't meant for anyone under 18. We don't knowingly collect or keep personal data from people under 18. If we find out we have, we take steps to delete it promptly. See our Terms of Service for more.

Additional information for US residents

Several US states have consumer privacy laws that give their residents certain privacy rights and require us to make additional disclosures. Depending on where you live, you may have the following rights:

  • Right to access: You have the right to access your personal data and get a copy of it in a portable format.
  • Right to correct: You have the right to ask us to correct inaccurate personal data.
  • Right to delete: You have the right to ask us to delete your personal data.
  • Right to opt out: You have the right to opt out of the sale of your personal data, or of targeted advertising.

To exercise these rights, email us at support@mileiq.com, as described in “What are my privacy rights?”

How to opt out

To opt out of the sale or sharing of your data, or of targeted advertising, go to the “Your Privacy Choices” section of the app's or site's privacy settings.

Sensitive data

We collect precise geolocation, which some state laws consider sensitive, only with your permission and only to provide MileIQ's features. We don't sell precise geolocation or use it for targeted advertising.

Opt-out preference signals

We recognize opt-out preference signals, like Global Privacy Control (GPC). When we detect such a signal, we treat it as a request to opt out of the sale or sharing of your personal data and of targeted advertising for the browser or device sending it and, if you're logged in, for your account.

Right to appeal

If we decline to take action on your request, you can appeal our decision by emailing dpo@bendingspoons.com with the subject line “Privacy request appeal.” We'll respond within the time required by applicable law. If you disagree with our response, you can contact your state's Attorney General.

Right to nondiscrimination

We will not discriminate or retaliate against you for exercising your privacy rights.

Authorized agents

You can use an authorized agent to submit a request on your behalf. To do so, the agent must email us at support@mileiq.com and provide proof that you've authorized them to act for you, like a signed written permission. For requests to access, correct, or delete your data, we may also ask you to verify your identity directly with us or to confirm that you gave the agent permission. We may deny a request from an agent who doesn't provide sufficient proof of authorization.

Additional information for California residents

California law gives California residents certain privacy rights and requires us to make additional disclosures. If you live in California, this section applies to you.

We collect personal information from the following sources:

  • Directly from you (like your named locations, and the information you give when you sign up)
  • Automatically from the app when you use it (like your device information when you open the app)
  • From other sources (like mobile measurement partners, to see how our marketing campaigns perform)

We generate inferences about you based on your use of the app and other information we collect.

In the past 12 months, we've collected the following categories of personal information, as defined by California law. MileIQ runs on cloud-based infrastructure, so we've disclosed each of these categories for business purposes in that period:

  • Identifiers, like your name, email address, username, account ID, device identifiers, IP address, and pseudonymous advertising identifiers
  • Customer records (as described in Cal. Civ. Code §1798.80(e)), like your name, contact information, and billing details
  • Commercial information, like your subscription and purchase history
  • Internet or other electronic network activity information, like your usage history and device information
  • Geolocation data, like your precise or approximate location and the locations of your drives
  • Professional or employment-related information, like your employer and, if you use MileIQ Teams, your organization
  • Inferences drawn from the information above, like your preferences and which offers you're likely to be interested in
  • Sensitive personal information: precise geolocation

For details about the personal information we collect and why, see “What data is collected, and why?”

We may disclose your personal information to the categories of third parties described in “Who is my data shared with?”

We don't knowingly collect, sell, or share personal data about users under 18.

Other than precise geolocation data, we don't collect information that's considered “sensitive” under California law. We only use sensitive personal information (precise geolocation) for purposes permitted under the CCPA, like providing the services you request. For this reason, the right to limit the use of sensitive personal information doesn't apply.

We keep personal data as described in “How long is my data kept?”

Right to opt out of sale or sharing

We don't use programmatic targeted advertising on our site or app, and we don't sell your data.

We “share” (as California law defines it) a limited amount of data with our advertising and measurement partners, to understand how well our ads on other websites and apps perform and to stop showing ads to people who already use MileIQ. They only get a pseudonymous identifier and the fact that you signed up or turned on certain app permissions.

To opt out of sharing, go to the “Your Privacy Choices” section of the app's or site's privacy settings.

In the past 12 months, we've “shared” the following categories of personal information with the following categories of third parties:

Category of personal information
Categories of third parties
Identifiers (a pseudonymous identifier)
Advertising and measurement partners
Internet or other electronic network activity (the fact that you signed up or turned on certain app permissions)
Advertising and measurement partners

Access, correction, and deletion

Your rights include the following:

  • Right to know: You have the right to ask what personal information we've collected about you and how we've used and shared it, and to get a copy of this information.
  • Right to correct: You have the right to ask us to correct inaccurate personal information.
  • Right to delete: You have the right to ask us to delete your personal information.
  • Right to nondiscrimination: We won't discriminate or retaliate against you for exercising your privacy rights.

To exercise these rights, email us at support@mileiq.com, as described in “What are my privacy rights?”. We don't require you to waive these rights to use MileIQ.

Additional information for EEA and UK residents

If you live in the EEA or the UK, you also have rights under the GDPR and the UK GDPR, which include the following:

  • Right to access: You have the right to ask for a copy of your data.
  • Right to rectification: You have the right to ask us to correct mistakes in your data.
  • Right to erasure: You have the right to ask us to delete your data.
  • Right to restrict processing: You have the right to ask us to restrict how we process your data.
  • Right to object to processing: You have the right to object to our processing of your data.
  • Right to data portability: You have the right to receive your data in a structured, commonly used, and machine-readable format.
  • Right not to be subject to automated individual decision-making: You have the right not to be subject to a decision based solely on automated processing.
  • Right to withdraw consent: Where we rely on your consent, you can withdraw it at any time by turning off “Analytics” or “Profiling” in the app's privacy settings or on the “Your Cookie Preferences” page linked in the footer of our site, or, for marketing messages, by changing your preferences in the “Notifications” section of the app's or site's settings. Withdrawing consent doesn't affect the lawfulness of processing carried out before you withdrew it.
  • Right to lodge a complaint with a supervisory authority: If you're in the UK, you can lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk/make-a-complaint/. If you're in the EEA, you can lodge a complaint with the data protection authority of the country where you live, work, or where you believe a violation occurred. You can find a list of EEA authorities at edpb.europa.eu/about-edpb/about-edpb/members_en.

Your right to object

You can object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest. If you do, we'll stop, unless we have compelling legitimate grounds that override your interests, rights, and freedoms, or we need the data to establish, exercise, or defend legal claims. You can also object to the use of your data for direct marketing at any time, for any reason, and we'll stop processing it for that purpose.

Tracking technologies

Where we use cookies or similar technologies for the purposes described above, we ask for your consent before using non-essential ones. You can withdraw your consent at any time in the app's privacy settings or on the “Your Cookie Preferences” page linked in the footer of our site.

Automated decision-making

We use profiling to personalize your experience and the promotional offers we show you, as described in the “Customization” and “Marketing” purposes above. However, we don't make decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you.

How to exercise your rights

To exercise these rights, email us at support@mileiq.com, as described in “What are my privacy rights?”.

If you're in the UK, you can also lodge a complaint directly with us about how we process personal data or about our compliance with UK data protection law by emailing support@mileiq.com. We'll handle your complaint in line with the ICO's guidelines on data protection complaints.

Our EEA representative is Bending Spoons S.p.A., Via Nino Bonnet 10, 20154 Milan, Italy. If you're in the EEA, you can email our representative at eurepresentative.mileiq@bendingspoons.com.

Where your data comes from

We collect personal data from the following sources:

  • Directly from you (like your saved locations, trip names, and the information you give when you sign up)
  • Automatically from the app when you use it (like your device information when you open the app)
  • From other sources (like mobile measurement partners, to see how our marketing campaigns perform)

Most of the data we collect is necessary to provide MileIQ under our Terms of Service. If you don't provide the data needed for purposes based on “contract” (see “Purposes” above), you won't be able to use MileIQ or the related features. Providing data for purposes based on consent or legitimate interest is optional. Withdrawing your consent or objecting won't stop you from using MileIQ's core features.

Will I be told if this policy changes?

We update this policy from time to time. When we do, we'll change the date at the top. For some changes, we'll also tell you by email, an in-app or on-site pop-up, or a push notification.

Glossary

Data controller: The company that decides why and how your personal data is used. For MileIQ, that's Bending Spoons US Inc.

Data processor: A company that handles personal data for us, following our instructions.

Personal data: Any data that can reasonably be linked to you or your household.

Processing: Anything that's done to data (for example, collecting, storing, or using it).

Profiling: Using automated processing to analyze or predict things about you, like your interests or which offers you're likely to want.

Pseudonymous identifier: A code, like a random ID, that links data to your account or device without showing your name or contact details.

Retention period: How long we keep data before deleting or anonymizing it.

Selling or sharing: When you see “sell or share” in this policy, it means giving your data to another company in exchange for money or something else of value, or so that they can use it for cross-context behavioral advertising. Neither includes passing your data to data processors.

Legal bases explained

In some jurisdictions, we can only use your data when we have a specific legal reason for doing so. These are called “legal bases.” MileIQ relies on five legal bases:

  • Contract: When you sign up for MileIQ, you enter into an agreement with us (our Terms of Service). We use your data when it's necessary to perform that agreement, like making MileIQ functional and available and offering you support, or to take steps you've asked for before entering into it, like creating your account.
  • Legal obligation: We have to use your data to comply with the laws and regulations we're bound by.
  • Consent: You've given us permission by opting in to a specific type of processing. For example, users in the EEA and the UK can opt in to “Profiling” or “Analytics” trackers.
  • Legitimate interest: We sometimes use your data in ways that benefit both of us. Whenever we process data on this basis, we explain in this policy what interest we're pursuing. For example, we have a legitimate interest in preventing fraud. We always balance our interests with your rights.
  • Vital interest: On rare occasions, we might use or share your data to protect someone's life (yours or someone else's) or to handle an emergency.

(The legal bases might have different names depending on where you live.)
